OBLIGATIONS OF YOU AND THE OTHER PERSONS INCLUDED IN THE HOLIDAY
TO US AND OUR RIGHTS AND OBLIGATIONS TO YOU AND YOUR PARTY. UPON
OUR ACCEPTANCE OF YOUR BOOKING THESE PROVISIONS WILL FORM PART
OF YOUR CONTRACT WITH US, INTOBARCELONA LTD. WE ARE A COMPANY
REGISTERED IN ENGLAND AND WALES NO 4993681.
HOW YOU MAKE YOUR CONTRACT WITH
US
When you
make a booking, the person to whom an email confirmation is sent
is the 'Lead Name' and he/she must have authority to accept these
booking conditions on behalf of your party. A confirmation email
is issued to the Lead Name, which forms the basis of the booking.
Please check this carefully. Whilst we make every
effort to ensure accuracy, the onus is on you, the client, to
ensure your reservation is correct. Any discrepancies must be
notified to us immediately. We regret we cannot accept liability
if we are not notified of inaccuracies within 7 days of receipt.
You are
advised to take a copy of the confirmation email with you on your
holiday.
A contract
shall only exist between intoBarcelona Ltd and the customer
(including all in the party) when intoBarcelona Ltd receives
the customer's full payment. intoBarcelona Ltd cannot
be held responsible for flights or transfers made outside the
company. Receipt of credit/debit card payment, cheque or direct
bank transfer constitutes acceptance of our booking conditions
.
PAYMENT
All IntoBarcelona
holidays must be paid IN FULL at least two weeks prior to departure.
You can either pay when reserving the holiday or, a reminder will
be sent three weeks prior to travelling. If we do not receive
the full payment by the due date you will be liable for an administration
charge of £25.
CHANGES AND CANCELLATIONS BY YOU
All changes should be made directly
with intoBarcelona Ltd. The first change
is free of charge; all subsequent amendments are charged at £15
per change. Cancellation is deemed to have taken place for a section
of a booking where there is withdrawal from a whole activity,
reduction of an activity numbers below provider's minimums, or
reduction in a whole night's accommodation.
All cancellations
must be received by email or telephone immediately. Charges are
as follows
14-0
days before departure 50% of full payment or section of a booking
14-28
days before departure 25% of full payment or section of a booking
More
than 28 days before departure full refund of full payment or section
of a booking
Remember that if you cancel for a
reason covered by your insurance policy you should make a claim
against the insurance company directly.
CHANGES BY US
If for
any reason beyond the control of intoBarcelona
Ltd the accommodation is required to be changed, intoBarcelona
Ltd reserves the right to offer alternative accommodation of the
same or superior rating at no extra cost to the client. Should
it not be possible to offer an alternative other than a lower
rated accommodation, intoBarcelona Ltd
will refund the difference. The customer can select whether to
accept the change or to cancel the reservation without incurring
any cancellation charges. Compensation arrangements do not apply
to circumstances beyond our control. We can cancel your holiday
in the following circumstances: war, threat of war, riots, civil
strikes or terrorist activity, industrial disputes, natural or
nuclear disasters, fire, airport closures, bad weather conditions
and similar events beyond our control.
If we breach
our contract with you in any other way we will pay appropriate
compensation if this has affected the enjoyment of your holiday
save that we will not be liable to you for damage caused by any
failure to perform our contract or improper performance if it
is attributable to:

Your own fault or that of a member of your party
- A third
party unconnected with the holiday services we have contracted
to provide you with and which is unforeseeable or unavoidable;
or - Unusual or unforeseeable circumstances beyond
our control, which could not have been avoidable even if all reasonable
care had been taken
- Events
which neither our suppliers nor we could have foreseen or forestalled
even if we had taken all reasonable care.
INSURANCE
It is the
responsibility of the customer to ensure they have booked an insurance
policy with adequate cover for European travel.
FLIGHTS/TRAVEL
The
responsibility for transportation from the UK
to Barcelona remains with the customer.
We cannot take any responsibility for late arrivals
or problems with your chosen carrier. However, as is our policy,
we will do our utmost to help put you in touch with flights and
any transport requirements at the destination.
Flights
- These can be obtained in many ways and are explained
in detail on the website
Car
Hire - You may prefer to hire a car for your
use during the holiday. In which case we will put you in touch
with car hire firms at the airport, or will arrange it for you.
Please pay them directly.
Please
remember that this is purely a service that we provide for which
we do not make a charge or take any responsibility whatsoever.
The contract will exist between you and your supplier.
SPECIAL REQUESTS
Please
inform us of any special request such as ground floor rooms when
you confirm your holiday booking. These details must be inserted
in the comments section on your Booking Form. Although we will
endeavour to meet special requests this is dependent on our suppliers
and we cannot guarantee that your requirements will be met.
APARTMENT DESCRIPTIONS
Descriptions
of the apartments represent an evaluation by which attempts to
reflect the style and atmosphere of the accommodation. Since the
views expressed are subjective, it is appreciated that not everyone
will agree with them and they should be read in this light. We
cannot undertake to provide the same rooms as may be shown in
the photograph in the details.
ACTIVITIES AND PRICES
intoBarcelona
Ltd website descriptions reflect our understanding of each activity
we offer and are given in good faith. We reserve the right to
vary prices without notice because of fluctuations in the exchange
rate.
YOUR FEEDBACK
intoBarcelona
Ltd will appreciate feedback - good or bad. If you have any cause
for complaint during your break, we strongly advise you to raise
it with intoBarcelona Ltd's offices
in Barcelona at the time. If it is considered reasonable to seek
redress from us on the spot, it is generally not considered reasonable
to seek redress from us at a later date. If problems cannot be
resolved there and then, please notify intoBarcelona
Ltd by email within 14 days and we will do our best to reply within
7 days. Failure to follow this procedure excludes us from liability.
